1. Agreement to Terms

These Terms of Service ("Terms") constitute a legally binding agreement between you and ProVision Digital Services, LLC ("ProVision," "we," "us," or "our") regarding your use of SermonAssist Pro, including our website, services, and applications (collectively, the "Service").

By accessing or using the Service, you confirm that you:

• Are at least 18 years of age
• Have the legal authority to enter into this agreement
• Agree to comply with all terms and conditions outlined herein

2. Description of Service

SermonAssist Pro is an AI-powered sermon preparation platform designed to assist pastors and ministry leaders in creating biblically-grounded sermon content. Our Service includes:

• Automated sermon outline generation
• Biblical commentary and exegetical resources
• Bible study creation tools
• PowerPoint slide generation
• Original language (Hebrew & Greek) insights
• Denominational theology customization
• Access to our proprietary Solomon AI theological engine

3. Account Registration and Subscription

3.1 Account Creation

To use SermonAssist Pro, you must create an account by providing:

• A valid email address
• A secure password
• Payment information (processed securely through Stripe)

You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account.

3.2 Free Trial

All new users receive a 2-week free trial period. During this trial:

• You have full access to SermonAssist Pro features based on your selected tier
• A valid credit card is required to prevent abuse
• You will not be charged until the trial period ends
• You may cancel at any time during the trial without charge
• If you do not cancel before the trial ends, you will be automatically charged for your first subscription period

3.3 Subscription Tiers and Pricing

SermonAssist Pro offers three subscription tiers:

All prices are in U.S. Dollars and are subject to change with 30 days' notice. Price changes will not affect your current billing period.

3.4 Billing and Payment

• Subscriptions are billed monthly on a recurring basis
• Payment is processed on the same day each month that you subscribed
• All payments are processed securely through Stripe
• If a payment fails, we will attempt to process it again. Continued payment failure may result in service suspension
• You are responsible for providing current, complete, and accurate billing information

3.5 Cancellation and Refunds

You may cancel your subscription at any time:

• Cancellation can be done through your account settings
• Upon cancellation, you will retain access until the end of your current billing period
• No refunds are provided for partial months of service
• After cancellation, your account and sermon content will be retained for 30 days, after which they will be permanently deleted

4. Acceptable Use Policy

You agree to use SermonAssist Pro only for lawful purposes and in accordance with these Terms. You agree NOT to:

4.1 Prohibited Uses

• Use the Service for any illegal or unauthorized purpose
• Share your account credentials with others (except for authorized users on Ministry tier plans)
• Attempt to reverse engineer, decompile, or extract the Solomon AI technology
• Use automated tools to scrape, data mine, or excessively query our Service
• Interfere with or disrupt the Service or servers
• Upload malicious code, viruses, or harmful content
• Impersonate any person or entity or misrepresent your affiliation
• Use the Service to generate content that promotes hate speech, violence, or discrimination

4.2 Ministry Use Requirement

SermonAssist Pro is designed specifically for Christian pastors and ministry leaders. By using this Service, you affirm that you are using it for legitimate Christian ministry purposes.

5. Intellectual Property Rights

5.1 Your Content

You own the sermon content you create. SermonAssist Pro does not claim ownership of the sermons, Bible studies, or other ministry materials you generate using our Service. You retain all rights to your original content and may use it freely in your ministry.

5.2 Our Technology

ProVision Digital Services owns all rights to:

• The SermonAssist Pro platform and software
• Solomon AI technology and algorithms
• Our theological knowledge base and training data
• All trademarks, service marks, and branding
• Website design, layout, and interface

5.3 Biblical and Theological Resources

SermonAssist Pro incorporates public domain biblical commentaries and theological resources. These materials remain in the public domain and are not subject to our copyright.

5.4 License to Use Our Service

We grant you a limited, non-exclusive, non-transferable license to access and use SermonAssist Pro for your personal ministry purposes, subject to these Terms. This license terminates upon cancellation of your subscription.

6. AI-Generated Content and Disclaimers

6.1 Your Responsibility

You acknowledge and agree that:

• You are solely responsible for reviewing all AI-generated content for theological accuracy
• You must verify all Scripture references and biblical interpretations
• You retain final authority over all sermon content delivered to your congregation
• You should apply your theological training, denominational understanding, and pastoral wisdom to all generated content
• SermonAssist Pro is a research and preparation tool, not a substitute for personal study and prayer

6.2 No Theological Guarantees

While we strive for theological accuracy and biblical fidelity, we make no guarantees that:

• All generated content will align perfectly with your theological tradition
• Every interpretation or application will be appropriate for your specific congregation
• The AI will never make errors in biblical references or theological concepts

6.3 Denominational Customization

Our denominational customization feature tailors content to various Christian traditions. However, you remain responsible for ensuring all content aligns with your specific denominational beliefs and practices.

7. Limitation of Liability

7.1 Service "As Is"

SermonAssist Pro is provided on an "as is" and "as available" basis. We make no warranties, expressed or implied, regarding:

• The accuracy, completeness, or reliability of sermon content
• Uninterrupted or error-free service
• The results that may be obtained from using the Service
• The correction of any errors or defects

7.2 Limitation of Damages

To the maximum extent permitted by law, ProVision Digital Services shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to:

• Loss of profits, revenue, or business opportunities
• Loss of data or sermon content
• Cost of substitute services
• Any claim arising from the use or reliance on AI-generated content

Our total liability to you for any claim arising from these Terms or your use of the Service shall not exceed the amount you paid us in the 12 months preceding the claim.

7.3 Exceptions

Some jurisdictions do not allow limitations on implied warranties or limitation of liability for incidental or consequential damages. In such jurisdictions, our liability will be limited to the greatest extent permitted by law.

8. Data and Privacy

Your use of SermonAssist Pro is also governed by our Privacy Policy, which is incorporated into these Terms by reference. Please review our Privacy Policy to understand how we collect, use, and protect your information.

Key privacy commitments:

• Your sermon content is private and confidential
• We never use your sermons to train our AI models
• We never share or sell your data to third parties
• Solomon AI runs on our private infrastructure, not external AI services

9. Service Availability and Modifications

9.1 Service Availability

We strive to provide reliable, uninterrupted service. However, we reserve the right to:

• Modify, suspend, or discontinue any aspect of the Service with or without notice
• Perform scheduled maintenance that may temporarily affect service availability
• Make emergency changes to address security or technical issues

9.2 Changes to Terms

We may modify these Terms from time to time. When we do:

• We will update the "Last Updated" date at the top of this page
• For material changes, we will provide at least 30 days' notice via email
• Your continued use of the Service after changes take effect constitutes acceptance of the new Terms
• If you do not agree to modified Terms, you must cancel your subscription

10. Account Termination

10.1 Termination by You

You may terminate your account at any time by canceling your subscription through your account settings or by contacting support.

10.2 Termination by Us

We reserve the right to suspend or terminate your account if:

• You violate these Terms of Service
• You engage in fraudulent activity or payment disputes
• Your use of the Service creates risk or legal liability for us
• You use the Service in a manner that harms other users

10.3 Effect of Termination

Upon termination of your account:

• Your access to the Service will be immediately revoked
• You will lose access to all stored sermon content
• Your personal data and content will be deleted after 30 days
• No refunds will be provided for remaining subscription time
• Sections of these Terms that by their nature should survive termination will remain in effect

11. Indemnification

You agree to indemnify, defend, and hold harmless ProVision Digital Services, its officers, directors, employees, and agents from any claims, damages, losses, liabilities, and expenses (including reasonable attorneys' fees) arising from:

• Your use or misuse of the Service
• Your violation of these Terms
• Your violation of any third-party rights
• Any sermon content you create or deliver to your congregation

12. Dispute Resolution

12.1 Governing Law

These Terms shall be governed by and construed in accordance with the laws of the State of North Carolina, United States, without regard to its conflict of law provisions.

12.2 Informal Resolution

Before filing any formal legal action, you agree to first contact us at support@provisiondigitalservices.com to attempt to resolve the dispute informally.

12.3 Arbitration

Any dispute that cannot be resolved informally shall be resolved through binding arbitration in accordance with the rules of the American Arbitration Association. The arbitration shall take place in North Carolina.

12.4 Class Action Waiver

You agree that any dispute resolution proceedings will be conducted only on an individual basis and not in a class, consolidated, or representative action.

13. Miscellaneous

13.1 Entire Agreement

These Terms, together with our Privacy Policy and Refund Policy, constitute the entire agreement between you and ProVision Digital Services regarding the Service.

13.2 Severability

If any provision of these Terms is found to be unenforceable or invalid, that provision will be limited or eliminated to the minimum extent necessary so that the remaining Terms remain in full force and effect.

13.3 No Waiver

Our failure to enforce any right or provision of these Terms will not be considered a waiver of those rights.

13.4 Assignment

You may not assign or transfer these Terms or your account without our prior written consent. We may assign our rights and obligations without restriction.
